Biography

The owner of The Law Office Jamay Lee A Professional Corporation, attorney Jamay Lee focuses her attention on litigating issues related to estate planning, elder abuse, trusts and conservatorships. A seasoned litigator, she has more than a decade of experience appearing before the courts of California challenging probate matters and advocating for clients on conflicts regarding trustees, beneficiaries, accounting and financial elder abuse.

A court-appointed member of the Independent Counsel Panel for San Mateo County Superior Court Trust, Probate and Conservatorship matters, Ms. Lee is an active and integral part of the California legal community. She has served as the co-chair of the Estate Planning and Probate Section of the San Mateo County Bar Association and presently is a member of its board of directors and the chair of its Diversity, Equity and Inclusion Committee. In addition, she holds active memberships in The State Bar of California’s Trusts and Estates, and the Litigation Sections; the Asian American Bar Association of the Greater Bay Area; the Asian Pacific American Bar Association of Silicon Valley and the Professional Fiduciary Association of California.

Proficient in her understanding of The California Probate Code and case law, Ms. Lee showcases the skills to navigate through complex matters involving private fiduciaries, administrators, conservators and personal representatives. She adds to her service to the society by working for nonprofit organizations and contributing to their cause. She is a board member of Raising a Reader, a community organization that promotes families to practice reading together with their children. Professional Experience

In a bench trial, involving breach of oral contract to make a will, quantum meruit and several other causes of action against decedent’s heirs, obtained judgment in favor of heirs on all causes of action.

In a bench trial involving a will contest, obtained judgment in favor clients and award of attorney fees pursuant to applicable statute.

In a one-week bench trial involving a Marvin action, obtained judgment in favor of clients on all counts.

Obtained summary judgment dismissing trust contest filed by beneficiary and secured payment of all of client’s attorneys’ fees and costs incurred in defense of contest.

Obtained early judgment on the pleadings dismissing contest filed by trustee and beneficiary of trust negating the need for discovery or further litigation.

In an elder abuse action, obtained dismissal with prejudice for client and compensation for attorney fees and costs before trial.

In a breach of fiduciary duty action, obtained dismissal of entire action against trustee client without payment of any claim before trial.

In a complex proceeding involving multiple actions and five law firms where client faced a $2 million surcharge, obtained very favorable global settlement relieving client of all liability and securing payment of all attorney fees and compensation to client.
